Rationale
Three bodies of Taiwanese law define what it means to be responsible for students beyond the subject taught. The Student Guidance and Counseling Act (學生輔導法) makes guidance a whole-school statutory duty organized in three tiers, from the developmental work of every classroom through intervention counseling to treatment-level professional services, with committees, staffing formulas, training hours, and a confidentiality duty behind it. The Campus Bullying Prevention Regulations (校園霸凌防制準則), comprehensively amended in 2024 under the Fundamental Act of Education's guarantee of students' freedom from corporal punishment and bullying, define the wrong precisely and build a machinery of twenty-four hour reporting, review and handling panels, hard timelines, protective measures, and mandatory counseling plans. And the Teacher Education Act (師資培育法) and Teachers' Act (教師法) frame the profession itself: how a teacher is formed, what rights and obligations attach to the role, and how the profession removes those who harm the students they were trusted with. Yet the working knowledge these regimes presume, where the tiers begin and end, what the bullying definition actually covers, what must happen within twenty-four hours of a suspicion, what a counseling plan must contain, what a colleague must do when the adult is the problem, is rarely taught systematically. This course teaches it, statute by statute and scenario by scenario, joining the legal spine to the daily craft of observation, referral, documentation, process cooperation, and classroom repair.
Part I: The Guidance Framework (Lessons 1-7)
Lesson 1. Every Teacher a Guidance Worker: The Student Guidance and Counseling Act
Why Taiwan legislated student guidance as a duty of the whole school. Participants examine the Act's purpose and definitions, the joint responsibility of principals, teachers, and professional personnel under Article 7, the proactive-care duty toward disadvantaged students, and the constitutional root of the whole regime in the Fundamental Act of Education's guarantee of students' learning rights, bodily autonomy, and freedom from corporal punishment and bullying. A running classroom narrative shows the statutory duty performed in an ordinary teacher's ordinary day, and participants leave able to state precisely what the guidance mandate asks of a classroom teacher and what it reserves for specialists.
Lesson 2. The Three-Tier Guidance Model
The organizing grammar of the whole course. Participants work through Article 6's three tiers, developmental guidance for all students, intervention guidance for identified needs, treatment-level guidance for severe cases, and Article 12's allocation of each tier to its people. The lesson teaches tier placement on realistic facts, the cumulative logic under which lower tiers keep operating beneath higher ones, escalation and de-escalation discipline, and the referral as a transfer of information rather than of burden. Participants practice locating students on the correct tier and defending the placement by the statutory language.
Lesson 3. Developmental Guidance in the Ordinary Classroom
The universal tier taken seriously as professional work. Participants unfold the statutory triad of life guidance, learning guidance, and career guidance, the school guidance work plan that converts aspiration into scheduled work, and the classroom practices, baseline observation, the guidance-intent class meeting, weighted attention to disadvantaged students, that constitute first-tier delivery. The lesson works the edge cases: the drift from weighted care into unreferred casework, the class meeting that is guidance in name only, cultural diversity inside universal content, and the student the first tier never surfaces.
Lesson 4. Intervention Guidance and the Referral Decision
The hinge competence of the guidance system. Participants examine the second tier's statutory population, where emotional distress qualifies a student with no misconduct required, and its measures: consultation, individual counseling, small-group guidance. The lesson then builds the referral craft: the calibration criteria, the six-element referral that transfers baseline, dated observations, first-tier responses, and family posture, the referral conversation with the student, and the referring teacher's continuing duties through the open case to disciplined closure. The mandated-reporting interface is worked explicitly: discoveries in counseling that meet the protection statutes report on their own twenty-four hour clock.
Lesson 5. Treatment-Level Guidance and the Professional Network
The tier where the school's boundary becomes deliberately porous. Participants map the licensed professions the Act engages, counseling and clinical psychologists and social workers, the student guidance and counseling centers each authority must establish, and the escalation markers that move a case to treatment level. The lesson draws the boundary around clinical work from both sides, teaches the classroom teacher's third-tier role of stable teaching and structured observation, and handles crisis response, information flow across many seams, the long middle of treatment cases, and re-entry. The transitional status of the 2024 amendment's staffing provisions is stated honestly.
Lesson 6. The Structures of School Guidance: Committees, Staffing, and Training
The machinery that makes duties performable. Participants examine the school student guidance and counseling committee, the guidance-teacher staffing formula verified against the current Chinese text, the authority-level advisory body and centers, and the training ladder that reaches every principal and teacher with statutory hours. The lesson works structure under friction: the paper committee, the staffing gap, the eroded full-time post, training as ritual, and the seam between school and authority, and equips teachers to use, staff, and when necessary name the failures of the structures around them.
Lesson 7. Guidance Records, Confidentiality, and the Duty of Discretion
The load-bearing wall of the guidance system. Participants study the confidentiality duty over professional secrets and its two exceptions, legal requirement and imminent peril, the designated-custody data architecture, and the Teachers' Act's parallel non-disclosure obligation. The lesson then works the real failure channels, staffroom conversation, visible documents, parental and official pressure, team over-sharing, record transfer at transitions, and builds the disciplines: need-to-know flow, prepared sentences, record hygiene, and the lawful exercise of exceptions with scope, record, and honesty.
Part II: Bullying Prevention and Response (Lessons 8-11)
Lesson 8. Defining Campus Bullying: The 2024 Prevention Regulations
The definition on which every duty hangs. Participants work the elements of the amended definition, persistence, mode including electronic and internet conduct, intent, the hostile or unfriendly environment, and mental, physical, or property harm, and the campus definition's reach across schools and beyond the school gate. The lesson teaches the hard boundaries, bullying against reciprocal conflict, teasing and humor, exclusion, the digital dimension, incidents engaging the gender-equity regime, and the routing rule that sends educator-on-student conduct to the personnel machinery. Recognition is taught as a professional practice with restraint on both inflation and minimization.
Lesson 9. First Response: Reporting a Suspected Bullying Incident
The clock and the channel. Participants master the reporting architecture: immediate notification to the school's designated responsible officer on learning of a suspected incident, the school's report to the competent authority within twenty-four hours, the three working day transfer rule for misdirected complaints, and the around-the-clock 1953 anti-bullying hotline. The lesson drills first-response discipline, safety scan, factual contemporaneous notes, evidence preservation within role, no private inquiries, no improvised mediation, the reluctant target, retaliation risk, and the parallel duties owed under the child-protection and gender-equity statutes on the same facts.
Lesson 10. The Handling Process: Committee, Panels, and Timelines
What the notification sets in motion. Participants map the standing prevention committee and its composition, the three-member acceptance review, the handling panel of three or five, and the two tracks of harmonization and investigation, including when consent-based resolution is suitable and when it is an evasion. The two month completion rule with its bounded extensions is worked arithmetically. The lesson then teaches the teacher's process roles: witness discipline anchored in the dated record, classroom stewardship over a class containing every party, confidentiality under pressure, and honest cooperation with outcomes through the process's own channels.
Lesson 11. After the Finding: Measures, Counseling, and Repairing the Class
The months the adjudication cannot reach. Participants study the protective measures, flexible attendance and assessment handling, reduced contact and transfer decisions weighed by protective purpose, retaliation and recurrence prevention, and the mandatory counseling plan for the actor and other involved persons, with content, division of labor, and timeline, delivered through the three-tier guidance machinery. The lesson works the aftermath's hard problems: the actor's dual status, the target's nonlinear recovery, the witness class, subtle retaliation as a new reportable incident, the unestablished case, and the after-action learning that converts one case into next year's prevention.
Part III: The Professional Framework (Lessons 12-15)
Lesson 12. When the Adult Is the Problem: Educator Conduct and the Teachers' Act
The course's hardest mirror. Participants examine the routing of educator-on-student bullying into the personnel-law machinery, the Teachers' Act's graduated sanctions from non-renewal and suspension to dismissal with lasting ineligibility where corporal punishment or bullying causes severe physical or mental harm, and the review committee procedures and thresholds behind them. The lesson then works the witnessing colleague's position: the notification duty, the channels including the bypass around compromised ones, the child protected within role, the false-allegation discipline, and the staffroom aftermath, arguing that credible machinery against the unfit teacher is the profession's own interest.
Lesson 13. Becoming a Teacher: The Teacher Education Act Pathway
How Taiwanese law builds a teacher. Participants trace the ordered gates: pre-service teacher education at designated universities, the national teacher qualification examination, the half-year full-time educational practicum with its four components of teaching, homeroom, and administrative practice plus professional development activities, and the teacher certificate issued by the central authority. The lesson examines the practicum's pressure points, real work under real supervision, what practicum students may see and must report, honest gatekeeping, and equips serving teachers for the mentoring role every reader eventually holds inside this pathway.
Lesson 14. Rights, Obligations, and Professional Growth Under the Teachers' Act
The twin articles read together. Participants study the enumerated obligations, protecting students' right to education, adaptive teaching, advising and disciplining students to guide appropriate growth, research and further study, non-disclosure, class teacher service, and the rights that make them performable: professional autonomy in teaching and counseling, further study with leave and funding architecture, organization membership, and appeal. The lesson works autonomy against accountability, the guidance-and-discipline duty's working test, the refusal right's honest reading, and builds the professional learning community as the collegial engine of guidance and prevention competence.
Lesson 15. Integration: A Semester in the Guidance and Prevention Framework
A full-semester simulation integrating every skill in the course. Participants follow one homeroom from September baselines through October referral, a November disclosure and same-day notification, the panel process and stewarded classroom through January, measures and counseling plans implemented exactly, a March retaliation case re-notified on its own twenty-four hour clock, and a June closure with after-action review, deciding ten numbered decision points against the statutes and defending each by article and record. The debrief scores the semester against the course and converts it into career practice: the personal protocol, the observation habit, and the learning community through which protective skill compounds.
