Course overview

Reviewer note. PELSB's 2026 review form pairs two mandatory topics in one section: Positive Behavior Intervention Strategies and Accommodating, Modifying, and Adapting Curricula. This submission concept addresses only the Positive Behavior Intervention Strategies half of that pairing. The accommodating, modifying, and adapting half is covered by the separate companion pilot MN-INST-001, Differentiated Instruction in Minnesota Classrooms, and providers pairing the two courses should present them together for that review section. The planned three-hour duration of this course is a design target that must still be pilot-validated before filing or certificate issuance. [S1, S2]

Minnesota Statutes section 122A.187, subdivision 4, requires teachers renewing a Tier 3 or Tier 4 license to complete further preparation in the use of positive behavior interventions. Minnesota also defines positive behavioral interventions and supports in statute: an evidence-based framework for preventing problem behavior, providing instruction and support for positive and prosocial behaviors, and supporting social, emotional, and behavioral needs for all students. This course teaches that framework as it applies to a licensed teacher's daily classroom decisions and connects it to the discipline provisions of Minnesota Statutes chapter 121A and the restrictive-procedures limits of section 125A.0942. The reviewer can locate evidence for the Positive Behavior Intervention Strategies criterion as follows. Instruction: every lesson, 1.1 through 6.2, teaches a component of the statutory PBIS framework, with lessons 1.2, 3.2, and 5.2 anchoring the Minnesota legal and equity context. Applied practice: required activities 1 through 10 each produce a behavior-support artifact, activity 11 is a three-case analysis, and activity 12 is a ten-section classroom behavior support plan capstone. Completion design

The intended live course requires 160 minutes of lesson instruction and applied activity, a 15-minute scenario assessment, and a 5-minute professional reflection and attestation: 180 active minutes total. It requires all 12 activities, the three-case lab, the ten-section capstone, and at least 80% on the 20-question assessment. Time is allocated to required reading, applied analysis, artifact creation, and assessment, not to an automatic lesson timer. The live platform must preserve responses or require artifact submission before completion. The section “Clock-Hour Basis and Time-on-Task Method” below documents the timing model with computed word counts and a research-based reading rate. [S3, S34]

Professional boundary: This course provides instructional and classroom-systems practice. It is not crisis-intervention or physical-restraint certification, does not authorize any person to use restrictive procedures under Minnesota Statutes section 125A.0942, and does not replace a student's IEP, 504 plan, behavior intervention plan, district discipline policy, or team decision. Follow current local procedures and seek authorized special-education and legal guidance for individual cases. The course itself is designed toward WCAG 2.2 AA as an internal goal and must undergo keyboard, screen-reader, document, and manual accessibility review before filing. [S9]

Positive behavior intervention strategies rest on one working premise: social behavior is learned, and what is learned can be taught, practiced, and strengthened the same way academic skills are. The Center on PBIS practice guide for educators frames classroom behavior support as instruction inside a multi-tiered system: universal practices for all students, targeted practices for some, and intensive individualized practices for a few. A teacher who treats a disruptive pattern as a skill gap to be taught responds differently, and far more effectively, than a teacher who treats the same pattern as a character flaw to be punished. The engine of this approach is function-based thinking. Behavior that repeats is working for the student in some way. Nearly every persistent classroom behavior serves one of two broad functions: to obtain something (adult or peer attention, a preferred item or activity, sensory input) or to escape or avoid something (a difficult task, a social demand, an overwhelming environment). The function is not an excuse; it is diagnostic information. A student who blurts to obtain attention needs a taught, reinforced, appropriate way to obtain attention. A student who blurts to escape a task that is too hard needs the task barrier addressed. Identical behaviors can require opposite interventions, which is why responding to the behavior alone so often fails. [S10, S14, S32]

Function is investigated through structured observation, usually summarized as ABC: Antecedent (what reliably happens right before), Behavior (what the student observably does), and Consequence (what happens right after that may maintain the behavior). The What Works Clearinghouse practice guide on reducing behavior problems makes this its first recommendation: identify the specifics of the problem behavior and the conditions that prompt and reinforce it before selecting any intervention. Precision matters. "Marcus is defiant" is an interpretation. "When given a multi-step written task, Marcus puts his head down and does not begin; an adult then sits with him one to one" is an observation that already suggests both a possible function (escape, with attention as a bonus) and a support. The learning principles underneath the framework

Function-based thinking is applied learning science, and three of its technical terms repay precise definition because everyday usage blurs them. Reinforcement is any consequence that increases the future probability of the behavior it follows; it is defined by its effect, not by anyone's intention, which is why a scolding that reliably produces laughter and repetition is functioning as reinforcement no matter how punitive it felt to deliver. Negative reinforcement is not punishment; it is the strengthening of a behavior because it removes something aversive, and it is the engine of most escape-maintained classroom behavior: the student acts, the difficult task goes away, and the acting is strengthened. Punishment, technically, is a consequence that decreases future behavior, and the research on exclusionary responses shows how rarely school consequences meet that definition: a removal that grants escape is reinforcement wearing punishment's clothing. [S10, S14, S19] Two further concepts complete the working kit. A setting event is a distal condition that changes how potent an antecedent is: short sleep, a missed meal, a morning conflict on the bus, or medication changes can make a task demand that was survivable on Tuesday intolerable on Wednesday, which is why identical antecedents do not always produce identical behavior and why "he was fine yesterday" is data, not refutation. And behavior can be multiply controlled: a behavior may obtain peer attention and escape a task at once, and the honest hypothesis names both and plans for both. The evidence base for building school systems on these principles is substantial: randomized controlled trials of schoolwide PBIS implementation report reductions in office referrals and suspensions and improvements in perceived safety and child behavior, with the usual caveat that effects depend on implementation fidelity. Worked example, elementary

A kindergartner screams and sweeps materials off the table during center transitions, roughly three times a week. The ABC record across six observations shows the antecedent is not transitions generally but transitions away from a preferred center before her structure is finished; the consequence is that an adult typically helps her rebuild it after calming, and twice she was allowed to stay. Two plausible functions emerge: obtaining continued access to the preferred activity, with adult attention as a secondary candidate. The hypothesis, "when signaled to leave an unfinished construction, she screams and sweeps materials, in order to keep access to the activity," is testable: a two-minute warning, a photograph ritual to save the structure, and a taught ask-for-two-more-minutes routine should reduce the behavior if the hypothesis is right, and the data will say so within two weeks. Note what the analysis avoided: no character claim, no maturity claim, and no intervention chosen before the pattern was established. [S10, S14]

Worked example, secondary

A tenth grader delivers a running comic commentary during teacher-led instruction in one class period. The reflexive reading is attention-seeking, and it may be right, but the ABC record complicates it: the commentary clusters in the fifteen minutes after independent practice is assigned, the laughter is real but brief, and the reliable consequence is a multi-exchange argument with the teacher during which no practice gets done. Peer attention and task escape are both on the table, and the escape column is quietly winning: the behavior costs him social capital by March but keeps buying him exits from work he starts and abandons. A quick review of his work samples shows accurate first steps and collapse on multi-step items. The support that follows looks nothing like an attention plan: modified entry into practice, a worked example on his desk, and a taught help-request, with the comic energy rerouted into a legitimate platform (he opens the review game on Fridays). The case illustrates the module's central discipline: the topography (joking) never determines the intervention; the function does. [S10, S14, S26]

Common failure modes at the foundation step

  • Topography-based intervention. The plan responds to what the behavior looks like (talking out gets a talking-out consequence) rather than what it earns. Diagnosis: the intervention could be written without knowing the consequence column. Repair: no plan until the ABC record exists.
  • Motive inference. "He does it on purpose" or "she just wants attention" said as accusation. Function is not moral purpose; wanting attention is a universal human need currently being met through the only route that reliably works. The professional question is what better route the classroom will teach. [S10]
  • The single-observation verdict. One dramatic incident becomes the theory of the child. Patterns require multiple observations across conditions; the format in this lesson exists precisely to slow that verdict down. [S14]
  • Skipping the setting-event check. A sudden behavior change is treated as a discipline problem when the calendar says state testing week and the record says the student's medication changed. Ask what changed in the conditions before asking what is wrong with the student.

Minnesota's Standards of Effective Practice make this stance a professional expectation, not a preference. Standard 2 requires teachers to understand and implement relationship-based, culturally affirming, and proactive approaches to behavior in order to improve student outcomes and reduce exclusionary practices. Function-based thinking is also an equity safeguard: it replaces adjectives about students ("lazy," "disrespectful," "attention-seeking" as an insult) with observations about conditions the teacher can actually change. [S4, S13] The rest of the course builds outward from this lesson: Module 2 engineers the conditions that prevent problem behavior, Module 3 disciplines the response when it occurs, Module 4 intensifies support when prevention is not enough, and Module 5 checks the whole system against data and against equity.

Required professional-learning activity

Choose one recurring, non-dangerous classroom behavior from your practice. Write an observable definition, record or reconstruct three ABC observations, and draft a one-sentence function hypothesis in the format above. Use no student-identifying information.

Artifact specification. A strong ABC artifact contains the observable definition, a three-row observation table (antecedent, behavior, consequence, plus a setting-event note where relevant), and the hypothesis sentence in the taught format. Quality criteria: (1) the definition would let two observers record the same events independently; (2) each consequence entry records what actually followed, including adult behavior, not what policy says should follow; (3) the hypothesis names obtain or escape (or defensibly both) and cites the pattern that supports it; (4) at least one rival function is named and the observation that would distinguish it is stated; (5) no interpretation words (defiant, lazy, attention-seeking) appear anywhere in the table.

Minnesota's statutory frame: what the law expects of behavior support

Positive behavior support in Minnesota is not only good practice; substantial parts of it are law. Minnesota Statutes section 122A.627 defines positive behavioral interventions and supports as an evidence-based framework for preventing problem behavior, providing instruction and support for positive and prosocial behaviors, and supporting social, emotional, and behavioral needs for all students. The statute names the schoolwide elements: three to five positively stated behavioral expectations that reflect local community and cultures; consistent staff-wide systems for acknowledging expected behavior; supports for students not meeting expectations; data systems to monitor progress and implementation; a continuum of evidence-based interventions; and collaborative teams that implement, monitor, and evaluate. Those six elements are, in order, the outline of this course. [S5]

The pupil discipline chapter reinforces the same direction. Minnesota Statutes section 121A.41, subdivision 12, defines nonexclusionary disciplinary policies and practices as alternatives to dismissing a pupil from school, explicitly including evidence-based positive behavior interventions and supports, social and emotional services, school-linked mental health services, counseling, social work services, academic screening, and alternative education services. Section 121A.45 requires that a pupil not be dismissed without first attempting nonexclusionary discipline, except where there is an immediate and substantial danger to self or others, and requires the district to attempt a meeting to assess mental health needs when a student's removals exceed ten cumulative school days in a year. In plain terms: the strategies taught in this course are the legally expected first response. [S6, S8]

The 2023 education amendments went further for young learners. Minnesota Statutes section 121A.425 protects full and equitable participation for students in prekindergarten programs through grade 3: dismissals of these students are prohibited except for removals of less than one school day, and expulsion or exclusion may occur only after nonexclusionary alternatives have been exhausted and only when there is an ongoing serious safety threat. The statute directs schools toward collaboration with families, mental health consultation, written support plans, and referral for services. A kindergarten teacher's behavior toolkit is therefore not optional equipment; for most situations it is the only lawful equipment. The Minnesota Department of Education's non-exclusionary discipline work translates these provisions into practice guidance, including classroom strategies and make-up work access for excluded students. How the statutory scheme fits together

Read as a system, the Minnesota provisions form three concentric layers of protection, and understanding the architecture helps a teacher act correctly without memorizing every subdivision. The outer layer is definitional and preventive: section 122A.627 defines what schools are supposed to build, and section 122A.187 obligates every renewing Tier 3 and Tier 4 teacher to be prepared to build it, so that the preventive framework is a workforce expectation rather than a program some buildings buy. The middle layer governs the moment of decision: sections 121A.41 and 121A.45 do not forbid dismissal, but they sequence it, requiring that nonexclusionary alternatives be attempted and documented first, absent immediate and substantial danger, which converts a teacher's classroom documentation from bureaucratic residue into the legally operative record. The inner layer draws absolute lines around the most intrusive responses: section 121A.425 for the youngest students and section 125A.0942 for restrictive procedures, where the legislature has decided that certain responses are unavailable regardless of professional judgment. A useful mental model for the classroom teacher: the outer layer is your daily work, the middle layer is your paper trail, and the inner layer is a set of walls you should never be close enough to touch if the outer layer is working. Federal law adds a parallel track for students with disabilities: IDEA requires IEP teams to consider positive behavioral interventions and supports for any child whose behavior impedes learning, and federal guidance urges proactive behavior support as the default posture, with discipline-related procedural protections layered on top. Worked example, elementary

A second grader has hit classmates twice this month during recess disputes. The principal asks the teacher to document "what we have tried" before the family meeting. Under the statutory scheme, this is not paperwork theater; it is the required record of nonexclusionary practice. A defensible file shows: the taught recess expectations and the re-teaching dates; the structured recess supports added after the first incident (assigned game choices, adult proximity at the wall-ball court where both incidents began); the acknowledgment data for the student's successful recesses; the family phone calls and what the family suggested; and the plan going forward, including a social-skills group referral. If a third incident produced an immediate-danger removal for the rest of the day, that removal is a "removal of less than one school day," within the section 121A.425 boundary; a three-day suspension would not be, and proposing one should trigger the teacher to raise the statute with the administrator, respectfully and in writing. Worked example, secondary

A ninth grader with no IEP has accumulated eight cumulative days of out-of-school suspension by January across three incidents. The mechanics of section 121A.45 now matter concretely: at the point removals exceed ten cumulative days in the year, the district must attempt a meeting with the student and family to assess whether mental health services are needed, so the tenth day is not simply another consequence; it is a statutory trigger the building should see coming. The teacher's contribution is the classroom record: which nonexclusionary supports were attempted before each referral, what the function evidence suggests, and whether the incidents share antecedents that a support plan could address. A teacher who can show that the second and third incidents followed the same unstructured-passing-time antecedent has converted a discipline file into an intervention design, which is what the statute is trying to make happen. Failure modes in the legal frame

  • Informal exclusion. "Take a walk," daily trips to the office that consume instructional hours, or quiet calls home to pick a child up early function as dismissals without the name or the record. Beyond the legal exposure, they destroy the data trail: the behavior's consequence column now reads "escaped class," and no one documented it. Route removals through the actual framework or do not use them. [S7, S17]
  • The exempt-student assumption. Believing the early-grade limits or nonexclusionary requirements do not apply to a particular child because the behavior is severe. Severity activates the immediate-danger exception narrowly and temporarily; it does not repeal the statute. Severe behavior is the strongest argument for the support planning of Module 4, not an exemption from it. [S7, S8]
  • Delegated discipline. Routinely handing behavior to whoever holds authority nearby, an administrator, a resource officer, converts an instructional problem into an enforcement event and abandons the teacher's statutory tools. The continuum in Module 3 exists so that the classroom keeps its own first response.
  • Documentation after the fact. Reconstructing "what we tried" the night before a meeting produces records that are thin, inaccurate, and visibly retrofitted. The documentation habit belongs in the daily system (Module 5), where it costs minutes, not evenings.

Boundary note. Statutory summaries in this course are instructional orientation, not legal advice. District policies implement these statutes with local detail, and special education law adds further procedural protections. When a question involves an individual student's rights or a contemplated removal, consult your administrator, the student's IEP or 504 team where applicable, and district counsel guidance. [S8, S9]

Required professional-learning activity

Locate your district's student discipline policy (or your handbook's behavior section). Identify where nonexclusionary practices appear, note whether the policy reflects the preK-grade 3 dismissal limits, and write two specific implications for your own grade level and role.

Artifact specification. A strong policy alignment note identifies the policy document by title and section, quotes or closely paraphrases the nonexclusionary language found (or documents its absence), and maps each of the three statutory layers to a local counterpart. Quality criteria: (1) the note distinguishes what the statute requires from what local policy adds; (2) any gap between policy and statute is stated neutrally as a question for the administrator, not a legal conclusion; (3) both implications are role-specific actions ("before referring for X in my grade, I must first document Y"), not restatements; (4) the note identifies where the teacher's own documentation would live and who reads it; (5) the note names the statutory trigger most relevant to the teacher's grade band.

Tier 1 is the universal layer of the framework: practices delivered to all students, designed so that most students, 80% or more in well-implemented schools, experience behavioral success without anything further. [S21] The foundation of Tier 1 is a small set of expectations, three to five, stated positively, and, as Minnesota's statute specifies, reflecting the local community and its cultures. "Be respectful, be responsible, be safe" is a common schoolwide set. The set only becomes usable when it is translated into observable behaviors for each routine of the day, because "be respectful" means something different in a lab, a discussion, a hallway, and an online forum. [S5, S11]

The working tool is a behavior matrix: expectations down one side, classroom routines across the top, and in each cell the two or three specific behaviors that count as meeting the expectation in that routine. A matrix converts adult assumptions into taught content. It also surfaces cultural judgment calls that deserve deliberate, community-informed decisions rather than in-the-moment enforcement: eye contact norms, movement, volume, help-seeking, and language practices vary across homes and cultures, and an expectation set that criminalizes normal variation will manufacture referrals. Involving students and families in writing the matrix is both statutorily aligned and practically protective. [S5, S10, S13]

Expectations are then taught the way any content is taught: tell, show, practice, feedback. An explicit behavior lesson names the skill and its rationale, models examples and near-nonexamples (the teacher, not a student, models the nonexample), rehearses in the real setting, and gives immediate specific feedback. The What Works Clearinghouse guide's third recommendation is exactly this: teach and reinforce new skills to increase appropriate behavior and preserve a positive classroom climate. [S26] Two companion practices multiply the effect. Precorrection is a brief reminder of the expected behavior delivered right before the situation where errors are likely ("Before we start labs: goggles on before the first pour, voices at partner level, signal me with a raised hand if a spill happens"). Active supervision is moving, scanning, and interacting throughout the space rather than anchoring at the desk. Both are free, and both consistently reduce problem behavior before it starts. Plan for re-teaching, not just teaching. Expectations are re-taught after breaks, before novel events, and whenever data show a routine drifting. A routine that has decayed is a signal about the system, not an indictment of the students. Teachers who re-teach calmly and without sarcasm preserve the relationship capital that every later strategy in this course depends on. [S10]

Why the design details are the way they are

Each specification in this lesson has a mechanism behind it. Three to five expectations, not ten, because the set must be memorable enough to be retrieved in the moment by students and, just as critically, by adults deciding whether behavior meets it; a list no one can recite governs nothing. Positively stated, because "no running" specifies only what to suppress, while "walk on the right" specifies the replacement behavior that can be taught, practiced, and acknowledged, and every later component of this course, precorrection, praise, the response continuum, needs a stated behavior to point at. Taught in the real setting, because behavior is under stimulus control: a skill rehearsed in the hallway becomes attached to the hallway's actual cues in a way a classroom lecture about hallways cannot achieve. The observational evidence links these practices to measurable differences: Gage and colleagues, observing teachers and students in elementary classrooms across three states, found that teachers implementing higher rates of these core management practices, active supervision, opportunities to respond, and specific feedback, had students with meaningfully higher engagement and lower rates of disruption, an association consistent with, though not proof of, the causal model this module teaches. [S26, S36] A further Tier 1 practice deserves explicit mention because it is nearly free and experimentally supported: the positive greeting at the door. In a randomized study in middle school classrooms, Cook and colleagues found that a structured routine of greeting each student individually, precorrecting, and connecting at entry increased academic engaged time by roughly 20 percentage points and reduced disruptive behavior, an effect the authors attribute to establishing connection and behavioral momentum before instruction begins. [S38]

Three disciplines keep the continuum working. First, protect the function analysis: sending a student into the hall for escape-maintained behavior pays the behavior its asking price and guarantees a repeat performance. The response should deny the function where possible, and the taught replacement behavior (Lesson 4.2) should supply a better route to the same need. Second, stay out of the argument: public power struggles are audience-fueled, and the teacher supplies the audience. Brief, private, neutral delivery followed by walking away wins more compliance than any speech. Third, repair afterward: a short reconnecting interaction after a consequence ("That is settled; fresh start; I am glad you are here") is what keeps a corrected student a member of the classroom rather than an opponent of it. Everything in Modules 1 and 2 is de-escalation performed in advance: strong relationships, taught expectations, predictable routines, and task design that removes common triggers. During agitation (fidgeting, withdrawal, muttering, darting eyes), effective moves are quiet and supportive: reduce demands briefly, offer a break or water, use the student's regulation strategy if one is taught, increase space, lower your own voice. During acceleration (arguing, provocation, refusal aimed at drawing engagement), the discipline is to disengage from the argument while staying connected to the person: short calm statements, no sarcasm, no new demands, no audience, a clear simple direction with take-up time. At peak, the priorities collapse to safety: move other students away, send for the designated support per your building's crisis procedure, keep your distance and your calm, and stop teaching the behavior lesson, because no one learns at peak. During de-escalation and recovery, resist the impulse to process immediately; a drained student agreeing to anything is not learning. Re-engage with a low-demand task first, then later hold a brief, private debrief: what happened, what the student needed, what both of you will try next time, and how the student re-enters the community with dignity. Minnesota law draws bright lines around what may ever happen at peak, and every licensed teacher needs to know them before a crisis. Minnesota Statutes section 125A.0942 governs restrictive procedures, meaning physical holding and seclusion. Restrictive procedures may be used only in an emergency, meaning a situation with an immediate threat of physical harm, only by specifically trained personnel in listed roles, and must end when the threat of harm ends, with continuous observation throughout. Recovery, the phase most often botched: no processing that period; a neutral re-entry task with a guaranteed early success the next day; the debrief happens forty-eight hours later, brief and private, and produces one adjustment to the plan rather than an apology extracted for the record. Failure modes in de-escalation

  • Arguing at acceleration. The student's argument is an invitation to co-escalate, and every audience member raises the stakes. Diagnosis: incidents whose narratives are mostly dialogue. Repair: scripted two-sentence responses, delivered privately, followed by planned disengagement with take-up time. [S10, S35]
  • Processing at the wrong phase. Demanding reflection during de-escalation or early recovery, when the student is physiologically drained, yields either hollow compliance or re-escalation. The debrief is a calm-phase activity, scheduled, brief, and forward-looking. [S35]
  • Treating restrictive procedures as consequences. Restraint and seclusion are emergency safety measures under section 125A.0942, never contingent responses to noncompliance, never available to untrained staff, and never lawful in their prohibited forms (prone restraint at any age; seclusion birth through grade 3). A staff culture that speaks of "giving him a hold" has already left the statute. [S9]
  • The calm-phase vacuum. Teams that meet only after incidents do all their work in the most expensive phases. The highest-yield de-escalation meeting reviews the two-column logs, adjusts antecedents, and rehearses scripts while everyone, adults included, is calm. [S14, S26]

Reconstruct one escalated incident from your practice (de-identified). Map it to the phases of the cycle, identify the earliest phase at which a different adult move was available, script that move, and note which statutory limits of section 125A.0942 would govern if the incident had reached peak.

Artifact specification. A strong incident map reads like flight data, not like a grievance. [S20] Tier 2 supports are deliberately efficient: standardized, continuously available, quick to start, and run with resources a school actually has, so that a student can begin within days of the data showing need rather than waiting months for a bespoke plan. The most widely implemented Tier 2 structure is a daily check-in and check-out cycle built around a point card carrying the school's existing expectations. The elements are simple and each one is doing measurable work. A morning check-in with a consistent, positive adult starts the day with connection and a precorrection. The student carries a card listing the three to five schoolwide expectations, and each teacher gives quick ratings plus behavior-specific feedback at natural transitions, which raises the feedback rate by an order of magnitude without new class time. An afternoon check-out reviews the day, celebrates points earned, and rehearses tomorrow's goal. The card goes home for family signature, converting the home-school channel from incident reports to progress reports. Design details determine whether Tier 2 helps or humiliates. Entry should be triggered by transparent data rules (Lesson 5.1), not by exasperation, and framed to the student as support and membership, never as a public mark of deviance. Why the cycle works: the active ingredients

Check-in/check-out is worth dissecting because each element maps to a mechanism this course has already taught, which is what makes the intervention teachable rather than magical. The morning check-in is precorrection plus noncontingent positive adult attention: the student receives connection before earning anything, which for attention-maintained behavior partially satisfies the function in advance and lowers the payoff of misbehavior. The point card is an antecedent prompt, a portable matrix that puts the expectations physically in front of the student at every transition. Failure modes at Tier 2

  • The card as rap sheet. Ratings delivered with lectures, or points deducted publicly, convert an acknowledgment system into a punishment schedule and reliably teach card-shredding.   • Entry by exasperation. When placement follows adult frustration rather than transparent data rules, Tier 2 rosters drift toward the students adults find irritating, which is an equity leak (Lesson 5.2) as well as a design failure. Entry, exit, and review all belong to written rules. [S12, S13]

Tier 3 serves the small number of students, roughly 1-5%, for whom universal and targeted supports are not enough. Its defining feature is individualization built on a functional behavioral assessment (FBA): a structured process that defines the behavior operationally, gathers ABC and interview data across settings, and produces a function hypothesis precise enough to design against. The hypothesis takes the same form you drafted in Lesson 1.1, now with more evidence behind it: in [context], when [antecedent], the student [behavior], and as a result [consequence]; therefore the behavior functions to [obtain/escape]. For students receiving special education services, FBAs and behavior intervention plans carry additional procedural requirements through the IEP process; for any student, the logic is the same. A competent function-based plan has four coordinated parts, and the coordination is the point. Prevent: change antecedents so the behavior is less necessary, adjusting task difficulty, providing choice, precorrecting, restructuring seating or transitions, or embedding the student's interests. Teach: explicitly teach a replacement behavior that serves the same function more efficiently than the problem behavior, such as a break card for escape-maintained behavior or a taught help-request and scheduled adult check-ins for attention-maintained behavior. Reinforce: make the replacement behavior pay reliably (honor the break card every time at first) while thinning reinforcement for the problem behavior. Respond: plan calm, consistent, function-aware responses for when the behavior still occurs, drawing on the Lesson 3.1 continuum and, if crises are foreseeable, a safety plan that stays inside the limits of section 125A.0942. The general education teacher's role on a Tier 3 team is substantial: you hold the richest observational data, you implement most plan components, and your feedback on feasibility determines whether the plan survives contact with a real classroom. The competing pathway: making problem behavior irrelevant, inefficient, and ineffective

The design logic underneath every sound Tier 3 plan can be stated as a competition. The problem behavior and the replacement behavior are two routes to the same functional outcome, and the student, like every organism the behavioral literature has ever studied, will allocate behavior toward the route that pays better: more reliably, more quickly, and at lower effort. A plan succeeds when it rigs that competition in the replacement's favor on all three dimensions at once. Prevention strategies make the problem behavior irrelevant: if task difficulty is calibrated and choice is available, the need to escape shrinks. Teaching plus reinforcement makes the replacement more efficient: a break card that works within five seconds beats a ten-minute escalation to the same hallway. Response planning makes the problem behavior ineffective: the old route stops paying. The most common technical error in real plans is a replacement behavior that costs more than the behavior it competes with, a full paragraph of self-advocacy demanded of a student whose current escape move is one shove of a desk; the shove will win. The WWC review of FBA-based interventions found individualized function-matched plans effective across seventeen single-case studies precisely because matching is the mechanism: the same break card that rescues an escape-maintained case does nothing for an attention-maintained one. A first grader's team completes an FBA after weeks of carpet-time elopement (the Lesson 6.1 pattern, worth studying twice). Hypothesis: during whole-group phonics drills, when called on or anticipating being called on, she leaves the carpet and hides under tables, and as a result escapes the task and receives one-to-one aide attention; the behavior functions to escape a task that current data show is two instructional levels too hard, with a secondary attention payoff. The four parts, checked against that hypothesis: Prevent: phonics instruction moves to a small group at her actual instructional level for ten minutes daily, and whole-group drills give her a defined job (card holder) that converts anticipatory dread into a role. Teach: a two-gesture break routine, touch the break card, move to the cozy corner for a timed two minutes, explicitly rehearsed when calm, plus daily instruction in the missing phonics skills, because the durable exit from escape behavior is competence. Reinforce: the break card is honored instantly every time in week one, and returning from break to the task earns specific acknowledgment and a tally toward a preferred classroom job; meanwhile the aide's attention shifts to precede behavior, two minutes of connection before carpet time, rather than follow it. Respond: if she bolts, the aide ensures safety silently, without chase or conversation (the old attention payoff), and the re-entry prompt is the same two-gesture routine. The plan is reviewed against a simple graph of elopements per day, and the written support plan, family collaboration, and nonexclusionary design double as the section 121A.425 documentation that governs any first grader. The FBA, run through his IEP team because federal regulation requires the team to consider positive behavioral interventions and supports when behavior impedes learning, complicates the obvious reading. [S30] ABC data across two weeks show the outbursts cluster during peer-editing tasks, and the interviews surface the driver: reading three grade levels below text, he detonates the interaction before a peer can discover it. The function is escape from anticipated humiliation, not teacher conflict. Failure modes at Tier 3

  • The plan that pays the function. A response section that removes an escape-maintained student, or convenes a three-adult conference around an attention-maintained one, funds the exact economy the teaching section is trying to close. Audit every response step against the hypothesis before signing. [S10, S32]
  • The overpriced replacement. If the replacement behavior is slower, harder, or less reliable than the problem behavior, the competition is lost at design time. Week-one rule: the replacement pays instantly and every time; thinning comes later. [S10, S14]
  • Half-strength delivery, full-strength verdict. Declaring failure for a plan implemented at half fidelity is the Tier 3 version of the Lesson 5.1 error, and it carries the student toward more restrictive placements on corrupt evidence. Implementation is recorded, honestly, before response is judged. [S12]
  • Setting events ignored. Hunger, missed medication, a chaotic bus ride, or a conflict at home change the value of every consequence in the room. Plans that note setting events, and quietly adjust demands on flagged days, outperform plans that treat every Tuesday as identical. [S14]
  • The safety plan that becomes the plan. When crisis procedures are invoked routinely, the team no longer has a behavior plan; it has a restraint schedule, and section 125A.0942's oversight provisions exist precisely to surface that drift. Minnesota's PBIS statute requires systems for using data-based decision making, and the framework supplies the method. The workhorse metric is the office discipline referral (ODR): a standardized record of a behavior event serious enough to involve the office, capturing what happened, where, when, who was involved, and the apparent motivation. ODRs are imperfect, they measure adult decisions as much as student behavior, a fact that becomes central in Lesson 5.2, but tracked consistently they reveal patterns no one can see from inside a single classroom: a hallway that generates referrals every day at 12:40, a spike after schedule changes, a cluster of task-avoidance referrals in one course. Classroom-level parallels include minor-incident tallies, your response-continuum documentation, and Tier 2 point-card percentages. [S5, S10, S12, S25]

Raw data becomes actionable through the precision problem statement, which answers five questions at once: what behavior, where, when, who, and why (perceived function). "Behavior in the cafeteria is out of control" is a mood. The habit of demanding precision before intervening is the single most transferable data skill this course teaches, and it applies identically to one student's point card and one building's referral database. Decision rules convert monitoring into decisions. Effective teams define, in advance, what response to data will trigger what action: for example, a Tier 2 student averaging at or above goal for four consecutive weeks moves to a fading plan; below goal for two weeks triggers a fidelity check before any change (was the intervention actually delivered as designed?); below goal after a fidelity-verified adjustment triggers Tier 3 assessment. Fidelity instruments such as the Tiered Fidelity Inventory apply the same discipline to the adults' system itself, asking whether Tier 1, 2, and 3 features are actually in place before concluding that students are failing a framework that was never fully implemented. The rule of the whole module: interrogate the system before interrogating the student. [S10, S12]

Two cautions keep data humane. Data exists to route support, not to build a prosecution file; a graph should change what adults do next week, or it is decoration. And small numbers deserve humility: three data points are a hint, not a verdict, and a single dramatic incident should not overturn a stable positive trend. Pair every graph with the student's own account; students are the only witnesses to the private events, task confusion, hunger, conflict from the bus, that the antecedent column is guessing at. Why written rules beat good judgment: the mechanism

The case for predefined decision rules is not that teams lack judgment; it is that unaided judgment about behavior data is systematically biased in knowable directions. Vivid single incidents outweigh weeks of quiet improvement in memory; the most recent data point feels like the trend; and the adult who wanted the intervention sees response where the graph shows noise, while the adult who doubted it sees failure in an ordinary dip. Rules written before the data arrive, four consecutive weeks at goal triggers fading, two below goal triggers a fidelity check, are a commitment device against those biases, exactly as the neutralizing routine of Lesson 5.2 is a commitment device at the level of a single referral. The validity research adds a second reason for humility that teams should say out loud: office referrals index adult decisions as much as student behavior, which is what makes them usable for spotting system patterns and hazardous for ranking individual children. Irvin and colleagues' validity work supports ODRs as an index of schoolwide behavioral status and intervention effect, a carefully bounded claim, and the disproportionality literature shows what happens in the unbounded uses. The building graph looks calm until the location view shows the playground generating three times its September rate, the time view putting the spike at the 11:40 lunch recess, and the behavior view coding it as minor physical contact among second graders. The precision statement nearly writes itself: minor physical contact referrals among second graders at 11:40 recess have tripled since the September equipment rotation removed the structured game zone, apparently maintained by peer attention in an unstructured space. Worked example, secondary

A ninth-grade team monitors one student's Tier 2 point-card percentages against the 80% goal: 84, 81, 77, 74 across four weeks. The exasperated reading is regression; the decision-rule reading is a two-week below-goal trigger, which routes first to a fidelity check. The check finds that two of five rating blocks stopped happening when a hallway duty changed, so the data drop coincides with a delivery drop, and the correct move is restoration, not intensification. Restored, the card runs 82, 85, 86, 88, and the four-week rule triggers fading discussions. Contrast the counterfactual: without the fidelity-first rule, the team escalates to a Tier 3 referral on corrupted data, the student inherits a more intrusive intervention he never needed, and the record now contains a failure that was manufactured by the adults' schedule change. One habit, checking delivery before interpreting response, is the difference, and it generalizes to every layer of the framework: implementation fidelity is measured with instruments like the TFI at the building level for the same reason. Failure modes in data use

  • Decoration graphs. Data displayed but never attached to a decision rule changes nothing and costs meeting time. Every graph in a team room should be answerable to the question: what will we do differently if this line moves? [S10]
  • The prosecution file. Data compiled to justify a removal already decided reverses the tool's purpose and usually announces itself: only negative events recorded, no fidelity data, no student voice. Minnesota's nonexclusionary framework makes such a file legally weak as well as ethically wrong, because the record must show support attempted, not merely misbehavior accumulated. [S6, S8]
  • Small-n verdicts. Three days of data after a plan change is a hint. Teams that respect their own review intervals avoid whiplash decisions that teach students the adults' systems are moods.
  • Two changes at once. Adjusting the intervention and the schedule and the seating in the same week guarantees that whatever happens next is uninterpretable. Change one variable per review cycle when the situation allows it.
  • Silence about referral subjectivity. A team that treats ODRs as pure student behavior will read its own decision patterns as student traits, which is precisely the mechanism Lesson 5.2 dissects. Minnesota's push toward nonexclusionary discipline is not abstract policy; it follows documented disparity. Beginning in 2017-2018, the Minnesota Department of Human Rights investigated dozens of districts and charter schools after finding that students of color and students with disabilities received a starkly disproportionate share of suspensions and expulsions relative to their share of enrollment, and it subsequently reached agreements with districts across the state to reduce those disparities in non-safety-related discipline. The Minnesota Department of Education's non-exclusionary discipline initiative and the 2023 statutory amendments you studied in Lesson 1.2 are part of the same arc. For a licensed teacher, the disparity data lands close to home, because most exclusionary discipline begins with a classroom referral decision. [S17, S18, S31, S33]

The research base identifies where disparity concentrates: not primarily in objective incidents such as weapons or violence, where definitions leave little room for judgment, but in subjective categories, defiance, disrespect, disruption, insubordination, where an adult must interpret ambiguous behavior in the moment. [S29] These interpretive moments are called vulnerable decision points, and they are most error-prone when the adult is hungry, tired, rushed, publicly challenged, or already frustrated with the student. Pair the routine with structural supports from this course: a written response continuum applied identically across students, subjective-category definitions agreed with your team, and a periodic self-audit in which you tally your own corrections and referrals by student and look honestly at the distribution. The honest shape of the evidence

A renewal course owes teachers precision about what the disparity evidence does and does not establish. What it establishes is scale and location. Nationally, the Government Accountability Office's analysis of federal civil rights data found Black students, boys, and students with disabilities disproportionately disciplined across every discipline type examined and regardless of school poverty level, which rules out the comfortable hypothesis that disparity is merely a poverty artifact. [S33] Federal special-education data show students with disabilities receiving suspensions at roughly double their enrollment share. [S31] Girvan and colleagues located the concentration: disproportionality loads onto subjective referral categories rather than objective ones, implicating adult interpretation at the decision point rather than large differences in underlying behavior. [S18] What the evidence does not establish deserves equal candor. PBIS implementation reliably reduces overall exclusionary discipline, the randomized trials and meta-analytic work support that claim, but reducing the total does not automatically close the gap; a system can suspend fewer students of every group while leaving the ratio between groups intact. Worked example, elementary

A kindergarten teacher, prompted by this course, runs a two-week self-audit: a simple tally of every correction and every acknowledgment, by student. The corrections column surprises her less than the acknowledgment column: two boys receive a third of the corrections, which she expected, but the same two boys appear almost nowhere in the acknowledgment tally, which she did not. Her vulnerable decision point turns out to be the 11:00 transition to line-up, when she is managing coats, folders, and a paraprofessional handoff at once; that is when "disruptive" attaches to behavior she absorbs without comment at 9:30. Her neutralizing routine, taped inside the closet door where she stands at 11:00: "Name the matrix row or let it go." Her structural change: the two boys become line leaders on alternating days, a role that converts her attention to them from corrective to acknowledging at the exact minute the data flagged, and the next tally cycle shows corrections halved and acknowledgments up ninefold for both. Nothing in the intervention required a committee; it required data she was initially reluctant to collect about herself, which is the honest cost of this work. [S10, S13]

Worked example, secondary

A high school's team disaggregates fall referrals and finds "defiance" referrals falling disproportionately on Black students, concentrated in the last period of the day and clustered among a handful of staff, a distribution matching the subjective-category research almost exactly. [S29] The response follows the five-point structure rather than a blame hunt. The data are presented to the full faculty as a system finding, with the base rates shown honestly. The team rewrites the referral form so that "defiance" cannot be submitted without an observable behavior description, a definitional change that converts a judgment into an evidence requirement. Staff build personal neutralizing routines for the flagged conditions, last period, public challenge, repeated prompts, using the two-question template this lesson teaches. The policy audit finds a dress-code provision that had been feeding confrontations and routes it to the site council. And the team commits to quarterly re-disaggregation with the results published to staff, because a one-time audit is an event, and the mechanism being interrupted is a habit. By spring, defiance referrals have fallen by half overall and the racial gap within them has narrowed measurably, while the objective-category referrals, the honest control group, remain flat, evidence the change happened where the intervention predicted it would: in adult interpretation. Failure modes in equity work

  • Equity as an annual event. A workshop in August with no disaggregation calendar behind it produces sentiment, not movement. The mechanism is quarterly data reviewed by named people on named dates. [S13]
  • Collected but never disaggregated. Schools that report only totals cannot see gaps, and not seeing is functionally identical to not looking. Minnesota's statutory expectation that expectations reflect community cultures implies the district can tell whether its system serves those communities. [S5, S13]
  • The data-quality deflection. When findings arrive, energy diverts into attacking the metric ("referrals are subjective anyway"). The subjectivity of referrals is not a rebuttal; it is the finding, and the appropriate response is tightening definitions and interrupting decision points, not discarding the mirror. [S25, S29]
  • Policy audit skipped. Handbook provisions that convert minor noncompliance, hoods, phones, "insubordination," into exclusion manufacture disparity wholesale and are the cheapest lever to fix, since a policy can be rewritten in a meeting. [S13, S17]
  • Praise inequity ignored. Auditing only corrections misses half the system. If acknowledgment flows to the students who need it least, the interaction-ratio intervention of Module 2 is being delivered inequitably even while referral counts look clean, and the students most in need of the relationship bank are left uninsured. Identify one vulnerable decision point in your own practice: the behavior category, the conditions that make you reactive, and any pattern you suspect in who receives your corrections. Write a neutralizing routine for it, word for word, and one structural change (definition, continuum step, or audit) that supports it. Artifact specification. This artifact is a professional instrument, and privacy of tone does not lower the bar. His teacher is exhausted and has asked whether Jonah can be sent home when it happens. Case C: escalation and the bright lines. Amara, a tenth grader, escalated in class after a public correction about her phone: arguing, then shoving her desk, then standing over a classmate shouting. The teacher shouted back, the class watched, and an administrator eventually walked Amara out. No one was injured. Map the incident to the escalation cycle, identify each point where a different adult move was available (including the public correction itself), script the agitation-phase and acceleration-phase responses you would use, describe a lawful peak-phase plan for a future incident, and state which actions section 125A.0942 would prohibit or restrict regardless of provocation. Then design the recovery-phase re-entry that preserves both accountability and membership. [S9, S10]

For each case, use the eight-part decision record:

  1. Observable behavior definition, stripped of interpretation.
  2. Antecedent and consequence pattern from the evidence given.
  3. Function hypothesis in testable form.
  4. Tier 1 conditions to verify or repair first.
  5. Targeted or individualized support matched to the function.
  6. Response and de-escalation plan, with exact language for key moments.
  7. Minnesota legal constraints that govern the case.
  8. Data to collect, the decision rule, and the team or family communication needed.

There may be more than one defensible answer. A high-quality response makes its assumptions visible, refuses to infer motive from identity, checks the adults' system before judging the student, and names when the information given is insufficient for a decision. [S10, S13]

Calibration guidance: what a strong record notices

Case A. The load-bearing observation is the discrimination in the antecedent data: elopement during letter-sound drills, rarely during read-alouds. Behavior that discriminates that cleanly between task types is broadcasting an escape function tied to specific task demands, and a strong record hypothesizes escape from phonological tasks that exceed current skill, then flags the confound the vignette plants: the aide who follows and sits with Jonah delivers attention contingent on elopement, so the FBA must separate the primary function from the maintaining side payment. The legal analysis should be exact rather than gestural: under section 121A.425, a first grader may not be dismissed except for removals under one school day, and expulsion or exclusion requires exhausted nonexclusionary alternatives plus an ongoing serious safety threat, which crawling under tables is not; sending Jonah home is therefore not among the lawful options, and the statute's expectation of a support plan and family collaboration points to exactly the four-part plan structure of Lesson 4.2. A record that also asks what Tier 1 looks like during carpet time, whether the drill's pace, length, and response format fit six-year-olds generally, before individualizing, has internalized the module's first rule: interrogate the system first. Case B. The strongest evidence in the vignette is distributional: five referrals, two class periods, four teachers with no concerns. Behavior that is context-specific to that degree is, by definition, under contextual control, and a strong record says plainly that "Dariel is simply disrespectful" fails on the evidence because trait explanations predict cross-context consistency the data refute. The referral language ("tone," "attitude," "refused to comply immediately") sits squarely in the subjective categories where disproportionality concentrates, so the vulnerable-decision-point hypothesis is not an accusation; it is a testable explanation ranked alongside others: a skills mismatch in those two courses, a relationship rupture, a schedule effect (both periods after lunch?), or genuine behavioral escalation that other teachers absorb. The distinguishing data are specifiable: direct observation in the flagged and unflagged periods, the two teachers' correction-and-acknowledgment tallies, task demands by period, and Dariel's own account, which the vignette conspicuously lacks. The proposed response should be layered and face-saving for everyone: definitional tightening of the referral categories, neutralizing routines for the flagged conditions, a structured relationship-repair move such as the greeting-at-the-door routine with precorrection, and a team review date with the disaggregated data on the table. Case C. The escalation map should locate the first adult contribution precisely: a public correction about a phone, delivered to a tenth grader in front of peers, is a trigger-phase move that predictably purchased acceleration, and the teacher shouting back is co-escalation, the audience-fueled error Lesson 3.2 names. A strong record scripts the counterfactuals: a private, delayed correction at the trigger phase; at agitation, distance and a low-demand written cue; at acceleration, the two-sentence disengagement with take-up time and the audience dispersed by re-engaging the class, not by confronting Amara. The peak-phase plan must be stated within the statute: staff without restrictive-procedures training do not physically intervene; the designated trained personnel respond per building procedure; any physical holding is lawful only in an emergency involving immediate threat of physical harm, must end when the threat ends, and prone restraint is prohibited regardless of provocation, a phrase worth writing verbatim because provocation is exactly the condition under which adults forget it. The re-entry design is where the record shows its values: a scheduled, private, brief debrief after recovery, a repair conversation with the classmate she stood over, restoration of classroom membership with a defined fresh start, and an antecedent change, the phone policy enforced privately by routine rather than publicly by confrontation, so the next incident is designed out rather than merely survived. Common reasoning failures in case analysis

  • Motive smuggled into the definition. "Jonah refuses to cooperate," "Dariel is disrespectful," "Amara exploded over nothing": each buries an interpretation where an observation belongs, and every downstream decision inherits the contamination. The behavior column contains only what a camera would record. [S10]
  • Topography matching. Choosing interventions because they suit the behavior's appearance (elopement means door alarms, shouting means detention) rather than its function is the single most common design error in real referrals, and all three cases punish it. [S14, S32]
  • Tier skipping. Records that leap to individualized plans without verifying the universal conditions, carpet-time task design in Case A, classroom acknowledgment ratios in Case B, the phone routine in Case C, individualize problems the system is causing. [S10, S12]
  • Law as afterthought. Treating sections 121A.425 and 125A.0942 as boxes to check after the plan is designed, rather than as constraints that shape the design space, produces plans that fail review and, worse, plans that harm students the statutes exist to protect. [S7, S9]

Design-hours claim. The recomputed model measures approximately 241 minutes of demand, roughly 4 clock hours: approximately 113 minutes of required technical reading at a research-based conservative rate, approximately 114 minutes of required artifact production across 12 activities, a three-case lab, and a ten-section capstone, and approximately 14 minutes of scored assessment work with feedback review. The course nevertheless claims only 180 active minutes, 3 clock hours of actual professional development under Minnesota Rules part 8710.7200, so the measured demand exceeds the conservative claim by a documented margin of approximately one third; participants reading at the meta-analytic mean rate of S34 rather than the conservative 180 words per minute would still meet or exceed the claimed 180 minutes.
